There’s been another development in the battle over the 46th Senate district. Republican George Amedore finished ahead of Democrat Cecilia Tkacyzk by 37 votes and says he's filed for his oath of office. But Tkaczyk says she's not giving up on the race.

Angry voters and community members delivered petition signatures to the appellate court Friday. They are calling on the court to rule in favor of counting all the ballots cast in the 46th state Senate district election between Tkaczyk and Amedore. Organizers say people shouldn't lose their votes because of a paperwork technicality.

"These voters are very angry their votes are not being counted. They wanted to vote. We tell them every vote counts but then their votes don't count. That is why almost 6,000 people in the past three days have signed this petition,” said Karen Scharff, Citizen Action Executive Director.

On Monday, an appeals court will hear Tkaczyk's case contesting the certification by a Montgomery County judge that invalidated nearly 450 ballots.

The first day of the new legislative session is scheduled to begin on Wednesday.
