A difficult week for many people across the Capital Region as two Shen seniors killed in a crash were laid to rest. As family and friends grieve, 22-year-old Dennis Drue, the man who police say hit the car the four teenagers were traveling in, is still not facing any charges. CAPITAL REGION, N.Y. -- The man police say was involved in the crash that killed two Shenendehowa high schoolers and injured two other teens isn't facing any charges for now.

According to police, after 22-year-old Dennis Drue was injured during the crash, blood was taken from him to determine if he was driving under the influence. Those results have not been released yet.

There are many charges Drue could face in this case, but police are holding out on pressing charges for a reason.

"If the police charge now, the defendant could plea to a misdemeanor charge and therefore, because of double jeopardy, maybe not be prosecuted for some further or more serious conduct arising out of the same transaction," legal expert Paul DerOhannesian said.

Before this crash, Drue has had his license suspended and had more than half a dozen traffic violations in the last five years. However, according to DerOhannesian, there's no such law that can prohibit a person from never driving again.
